Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and TaxDelete ("Company," "we," "us," or "our"). By accessing or using the TaxDelete website, submitting the qualification form, or purchasing our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.
Services Provided
TaxDelete provides document preparation services related to applying for IRS Currently Not Collectible (CNC) status. Specifically, for a flat fee of $149, we:
- Provide access to an online qualification form to assess potential eligibility for CNC status
- Assist you in completing IRS Form 433-F (Collection Information Statement) or Form 433-A based on information you provide
- Prepare supporting documentation and a submission packet formatted according to IRS requirements
- Provide general information about IRS allowable living expense standards
Services We Do NOT Provide
TaxDelete is a document preparation service only. We explicitly do NOT:
- Provide legal advice, tax advice, or financial advice of any kind
- Represent you before the IRS or communicate with the IRS on your behalf
- Act as your attorney, certified public accountant (CPA), enrolled agent, or tax professional
- Negotiate with the IRS regarding your tax debt or CNC status
- File your tax returns or prepare any tax returns
- Guarantee that the IRS will approve your CNC application
- Provide refunds if the IRS denies your CNC application or does not respond to your submission
- Assist with IRS representation, audits, appeals, or collection due process hearings

User Responsibilities
By using TaxDelete's services, you agree to:
- Provide accurate, complete, and truthful information in all forms and communications
- Review all completed documents carefully before submission to the IRS
- Understand that you are solely responsible for the accuracy of information provided to us and submitted to the IRS
- Submit your completed CNC application to the IRS (we prepare documents but do not submit them on your behalf unless explicitly stated)
- Maintain compliance with all IRS filing and payment requirements after CNC status is granted
- Respond promptly to any IRS requests for additional information or documentation
- Understand that CNC status does not eliminate your tax debt and that interest continues to accrue
- Consult with a licensed tax professional if you have questions about your specific tax situation
Eligibility Requirements
To use TaxDelete's services, you must be at least 18 years old, have a valid Social Security Number or Individual Taxpayer Identification Number (ITIN), owe federal tax debt to the IRS, and have the legal capacity to enter into a binding contract. Our services are designed primarily for taxpayers who owe less than $10,000, though taxpayers with higher debt amounts may also qualify for CNC status depending on their financial circumstances.
Payment and Fees
Our service fee is a flat rate of $149 paid at the time of service purchase. This fee covers document preparation only and is non-refundable regardless of the outcome of your CNC application with the IRS. Payment must be made through our secure payment processing system using a valid credit card or other accepted payment method. By providing payment information, you authorize us to charge the full service fee immediately upon purchase.
The $149 fee does not include any additional services beyond initial document preparation. If you require modifications to documents after submission, additional tax resolution services, or representation before the IRS, additional fees may apply (or you may need to engage a separate tax professional).
No Guarantees or Warranties
TaxDelete makes no guarantees, warranties, or representations regarding the outcome of your CNC application. Approval of CNC status is entirely at the discretion of the IRS based on their evaluation of your financial circumstances and compliance history. We cannot predict or guarantee that:
- The IRS will approve your CNC application
- The IRS will respond within any specific timeframe
- Your financial situation qualifies for CNC status
- CNC status, if granted, will remain in effect for any specific period
- Our service will result in any specific financial benefit or tax savings
Our services are provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our services will meet your requirements, that our website will be uninterrupted or error-free, or that any errors will be corrected.
Refund Policy
All sales are final. Our $149 service fee is non-refundable once payment is processed. For complete details, please review our Refund Policy. We do not provide refunds based on:
- IRS denial or rejection of your CNC application
- Lack of IRS response or delayed IRS processing times
- Changes in your financial circumstances after document preparation
- Your decision not to submit the prepared documents to the IRS
- Termination of CNC status by the IRS after approval
- Dissatisfaction with IRS collection practices or procedures
Refunds may be considered only in the event of a clear error on our part in document preparation or if we fail to deliver the services as described, subject to our sole discretion.
Limitation of Liability
To the maximum extent permitted by law, TaxDelete, its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use our services
- IRS denial of your CNC application or termination of CNC status
- IRS collection actions, penalties, or interest
- Errors or inaccuracies in information you provided
- Unauthorized access to or alteration of your data
- Any other matter relating to our services
In no event shall TaxDelete's total liability exceed the amount you paid for our services ($149). This limitation applies regardless of the legal theory upon which the claim is based, whether in contract, tort, negligence, strict liability, or otherwise.
Indemnification
You agree to indemnify, defend, and hold harmless TaxDelete and its owners, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of our services
- Your violation of these Terms
- Your violation of any applicable laws or regulations
- Inaccurate or fraudulent information you provided
- Your interactions with the IRS or any third parties
Intellectual Property
All content on the TaxDelete website, including text, graphics, logos, images, software, and design elements, is the property of TaxDelete and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without express written permission. The TaxDelete name, logo, and all related marks are trademarks of TaxDelete. IRS forms and publications referenced on our site are in the public domain and remain the property of the United States government.
Termination
We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, including but not limited to situations where we suspect fraudulent activity, false information, or violation of these Terms. Upon termination, your right to use our services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which TaxDelete is registered, without regard to conflict of law principles. Any dispute arising from these Terms or your use of our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if your claims qualify.
You agree to waive any right to a jury trial or to participate in a class action lawsuit. Arbitration proceedings shall be conducted on an individual basis only.
Modifications to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. Material changes will be effective upon posting to our website with an updated "Last Updated" date. Your continued use of our services after any changes constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.
Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published on our website, constitute the entire agreement between you and TaxDelete regarding our services and supersede all prior agreements, understandings, and communications, whether written or oral.
